under existing tort law precedent, a homeowner can sue a neighbour for trespassing if that neighbours' smoke seeps on to their property, but this isn't powerful enough. it is long overdue that these kinds of bylaws started getting passed, so that people don't have to tolerate their neighbours' smoking.
